These Terms govern your access to and use of Helmsman By Sailorscope (the "Service") provided by Deepsea Logic Media FZ-LLC, a Free Zone company in Ras Al Khaimah, UAE ("Sailorscope", "we"). By creating an account or using the Service you agree to these Terms.
1. Eligibility & accounts
You must be at least 18 and authorised to act for the company you represent. You are responsible for all activity under your credentials, including those of crew members you invite.
2. License
Subject to these Terms and your subscription, we grant you a non-exclusive, non-transferable, revocable license to access the Service for internal vessel-performance and commercial-operations use.
3. Acceptable use
- No reverse engineering, scraping, or circumventing security or rate limits.
- No use that violates maritime, export, sanctions or competition law.
- No upload of unlawful, infringing, malicious or false content.
- No resale or sublicensing without our written consent.
4. Your data
You retain all rights to data you submit. You grant us the rights necessary to host, process, analyse and display it for the Service, including for AI features you choose to invoke.
5. Subscriptions & fees
Fees, billing cycle and included modules are stated in your order or in the Service. Fees are non-refundable except as required by law. We may change pricing on renewal with 30 days' notice.
6. Service availability
The Service is offline-first and designed to operate without continuous connectivity, but we do not warrant uninterrupted availability of cloud sync, AI features or third-party integrations.
7. AI outputs
Captain AI and predictive analytics produce informational suggestions only. They are not a substitute for the professional judgement of the master, chief engineer or shore management. You remain responsible for all operational and commercial decisions.
8. Intellectual property
The Service, software, models, branding and documentation are owned by Deepsea Logic Media FZ-LLC or its licensors. No rights are granted other than those expressly stated.
9. Confidentiality
Each party will protect the other's non-public information with at least the same care it uses for its own.
10. Warranties & disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, fuel savings, charter-hire or goodwill. Our aggregate liability will not exceed the fees paid by you for the Service in the 12 months preceding the claim.
12. Indemnity
You will indemnify Sailorscope against claims arising from your data, your use of the Service in breach of these Terms, or your violation of law.
13. Termination
Either party may terminate for material breach not cured within 30 days. We may suspend access for non-payment, security risk or unlawful use. On termination your access ends; you may export your data for 30 days, after which we may delete it.
14. Governing law & jurisdiction
These Terms are governed by the laws of the Emirate of Ras Al Khaimah and the applicable federal laws of the United Arab Emirates. Disputes will be submitted to the competent courts of Ras Al Khaimah, without prejudice to mandatory consumer protections.
15. Changes
We may update these Terms; material changes will be notified in-app or by email.
